In consideration of the undersigned Participant (and each minor participant listed below) being allowed to participate in any way in llama activities (the "Activity") provided by Luxy Llama, LLC, a Colorado limited liability company (the "LLC"), Participant hereby agrees that Participant is 18 years of age or older, has legal responsibility for Participant's participation in the Activity (including legal responsibility for any minor participant listed below who shall also be a Participant for purposes of this waiver and release), and further agrees as follows:
There is a risk of injury from Participant participating in the Activity, including broken bones, torn or bruised muscles, sprained or twisted joints, as well as more serious injuries, such as paralysis and even death.
PARTICIPANT KNOWINGLY AND FREELY ASSUMES ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assumes full responsibility for Participant's participation in the Activity.
Participant willingly agrees that Participant will comply with the stated and customary terms and conditions for participation in the Activity, including all safety instructions given by Luxy Llama staff before and during the Activity.
Participant, on their own behalf and on behalf of Participant's heirs, assigns, personal representatives and next of kin, HEREBY RELEASES, INDEMNIFIES, AND HOLDS HARMLESS the LLC, its officers, managers, agents and/or employees, other participants, sponsoring agencies, and, if applicable, owners and lessors of premises used for the Activity (collectively, the "Releasees"), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property associated with Participant's presence or participation in the Activity, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
For each minor participant listed at the time of booking, the Participant enters into this Waiver and Release on their behalf, and confirms that Participant has the legal authority to do so.
This Waiver is governed by Colorado law. If any portion of this Waiver is held invalid, the balance shall continue in full legal force and effect to the greatest extent possible under Colorado law.
Acceptance of this Waiver through the online booking process, including checking the acceptance box and typing your full legal name, constitutes your electronic signature and has the same legal force and effect as a handwritten signature.
Warning
Under Colorado law, a llama professional is not liable for an injury to or the death of a participant in llama activities resulting from the inherent risks of llama activities, pursuant to section 13-21-119, Colorado Revised Statutes.
PARTICIPANT HAS READ THIS WAIVER AND RELEASE OF LIABILITY, FULLY UNDERSTANDS ITS TERMS, UNDERSTANDS THAT PARTICIPANT HAS GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING TO IT (AND HAS GIVEN UP SUCH RIGHTS FOR ANY MINOR PARTICIPANT ON WHOSE BEHALF PARTICIPANT AGREES TO IT), AND HAS AGREED TO IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE, AND INTENDING PARTICIPANT'S ELECTRONIC ACCEPTANCE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY COLORADO LAW.
